Terms of use

These terms are an agreement between you and Foundry Systems Ltd (company number 16940612, registered office 71–75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom), trading as Incbury ("we", "us"), covering your use of incbury.co.uk, Incbury Chat and Atom (the "Service"). By creating an account or using the Service you agree to them. If you use the Service on behalf of an organization, you confirm you have authority to bind it.

Your account

You must be at least 13 years old. Keep your credentials secure and enable two-factor authentication where possible. You are responsible for activity under your account. Tell us promptly at hello@incbury.co.uk if you suspect unauthorized access.

Acceptable use

You agree not to use the Service to:

• break the law or infringe anyone's rights;
• generate or distribute content that is abusive, harassing, sexually exploitative or hateful;
• attempt to access other users' data, probe or disrupt our infrastructure, or evade limits;
• build a competing model by systematically extracting Atom's outputs;
• present Atom's output as human-written where that would mislead someone to their detriment.

Content and output

You keep ownership of what you submit. You grant us the license needed to store, process and display it in order to run the Service. Subject to your compliance with these terms, you may use Atom's output for any lawful purpose. Output is generated by a machine learning model and may be wrong; check anything that matters before relying on it.

Plans, limits and payment

The Free plan includes daily and monthly usage limits which we may adjust. Paid plans renew automatically until canceled; cancellation takes effect at the end of the current period. Payments are processed by Stripe. We charge in pounds sterling, US dollars, euros, Brazilian reais or Japanese yen depending on your billing country, and in pounds sterling elsewhere; once a subscription starts, it stays in that currency. Prices exclude VAT, GST and sales tax; where applicable, tax is added for your billing country at checkout. Your bank may charge its own fees for payments in a foreign currency. We may change prices with at least 30 days' notice.

Sponsored cards

Free plan chats may include sponsored cards. They are labelled “Sponsored”, are shown separately from Atom’s answer and are chosen after the answer is written, so they do not influence it. Advertisers are responsible for their offers; we review ads but do not endorse them.

Advertising with Incbury Ads

Incbury Ads lets businesses buy sponsored cards with prepaid credit. You must be authorised to act for the business you advertise, and your ads and landing pages must be accurate and lawful. We do not accept gambling, political, adult, crypto, weapons or tobacco ads, and finance, healthcare and alcohol ads need manual review. We may reject, pause or remove any ad. Credit is charged per impression or per click at your bid. Introductory offer: once your paid top-ups total £500, we add £500 of promotional credit, once per business. Promotional credit is spent after paid credit, has no cash value and expires 90 days after it is added. We may change or end the offer for new advertisers at any time.

Teams

Team owners and admins can view and manage content inside their workspace, including inviting and removing members. If your account was created through a team, the team controls it.

Availability and changes

We work hard to keep the Service running but do not promise uninterrupted availability. We may change or discontinue features, and will give reasonable notice of material changes where we can.

Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate accounts that breach these terms or create risk for other users, giving notice where appropriate.

Disclaimers and liability

The Service is provided "as is". To the extent permitted by law we exclude all implied warranties and limit our liability to the amount you paid us in the twelve months before the claim, or £100 (or the equivalent in your billing currency) if you paid nothing. Nothing in these terms limits liability that cannot lawfully be limited.

Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, without affecting any mandatory consumer protections where you live.
